These terms set out the conditions for using “Kakesu” (the “App”), an iOS app provided by Toru Fukui (the “developer”). Anyone using the App (the “user”) does so having agreed to them.
If you obtained the App from the App Store, Apple's Standard End User License Agreement (EULA) applies. These terms supplement it. Where the two conflict, whichever is more favourable to the user prevails.
The App is free. There are no in-app purchases.
Data saved by the App is held on the user's device and in the user's own iCloud. The developer runs no server and holds none of the user's data. The developer therefore cannot restore data on the user's behalf.
Syncing between devices is entrusted to Apple's iCloud (CloudKit). A fault or a change in that mechanism may delay syncing or cause it to fail.
Article conversations are neither synced nor backed up; they remain on that device alone. They are lost when the user changes devices or deletes the App.
Once a week the App writes everything saved to a JSON file in the user's iCloud Drive. For anything important, we recommend keeping this copy somewhere else as well. How to do that is described in the guide.
The App is provided as is. The developer does not warrant that it fits any particular purpose of the user, that it is free of defects, that it is available at all times, or that saved data will not be lost.
The App also has no involvement in the contents of the web pages behind the URLs that are saved.
Answers from “Ask” and article summaries are generated by the on-device model. Their correctness is not warranted. To check them, consult the original bookmarks listed under the answer, or the article itself. A summary in particular is made by reading only the beginning of the page text, so it may not represent the article as a whole.
The developer is not liable for damage arising to the user from use of the App.
This does not apply where the damage is caused by the developer's intent or gross negligence. Nor does the exclusion above apply to the extent it is void under Japan's Consumer Contract Act where the user is a consumer within the meaning of that Act.
The developer may change the App, or discontinue it, without prior notice. Even if it is discontinued, the JSON backups already placed in iCloud Drive remain in the user's hands.
If these terms change, this page is updated and the date at the bottom is rewritten. Using the App after a change is taken as agreement to the changed terms.
These terms are construed under the laws of Japan.
